TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, registering for, or sending any API request through the Freeseek reverse proxy service ("Service"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all provisions contained herein, you are prohibited from using the Service and must immediately discontinue all access.

These Terms constitute a legally binding agreement between you and the Freeseek service operator ("Operator", "we", "us", "our"). Your continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.

2. SERVICE DESCRIPTION

Freeseek provides a free, high-speed reverse proxy gateway that forwards OpenAI-compatible chat completion requests from JanitorAI (and compatible frontends) directly to upstream DeepSeek API infrastructure. The Service includes:

• A REST/SSE-compatible /v1/chat/completions endpoint accepting the freeseek-flash model identifier.
• Automatic forwarding to the upstream DeepSeek deepseek-chat model.
• Per-user API key generation and management via a personal dashboard.
• Real-time server telemetry, latency measurement, and public usage statistics.
• Zero-buffering Server-Sent Events (SSE) streaming for real-time token delivery.

The Service is designed exclusively for use with JanitorAI roleplay applications and is not intended as a general-purpose AI API provider.

3. ELIGIBILITY & ACCOUNT REGISTRATION

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
• Register an account by providing a unique username and password.
• Explicitly accept these Terms of Service and the accompanying Privacy Policy during registration.
• Maintain the confidentiality and security of your account credentials and generated API key.

You are solely responsible for all activity that occurs under your account. You must immediately notify us if you suspect any unauthorized use of your account or API key. We reserve the right to refuse registration to any individual for any reason.

4. COMPREHENSIVE DATA LOGGING & TELEMETRY

Because this Service is provided entirely free of charge, all network activity passing through the proxy endpoint is recorded. By using the Service, you expressly consent to the logging and storage of the following data:

• Full Conversational Message Trees: All System, User, and Assistant message turns, including character system prompts, persona cards, scenario descriptions, and roleplay dialogue.
• Model Parameters: Model identifiers, temperature values, top-p sampling parameters, max token limits, frequency/presence penalties, and streaming flags.
• Request Metadata: Client IP addresses, timestamps, HTTP headers, request latency measurements, and prompt/completion token usage counts.
• Account Data: Usernames, hashed passwords, API keys, registration timestamps, cumulative usage statistics, and account status flags.

This data is stored in a local SQLite database and is accessible only by the service administrator via authenticated admin endpoints. Logged data is used for debugging upstream connectivity failures, measuring performance, preventing abuse, and administering the Service. For full details, see our Privacy Policy.

5. ACCEPTABLE USE POLICY

You agree to use the Service only for its intended purpose of JanitorAI-compatible roleplay interactions. The following activities are strictly prohibited:

• Abuse & Spam: Sending automated, scripted, or bot-driven requests designed to overload, stress-test, or degrade the Service.
• API Key Sharing: Distributing, selling, or sharing your personal API key with any third party.
• Circumvention: Attempting to bypass rate limits, authentication mechanisms, model restrictions, or any security controls.
• Unauthorized Access: Attempting to access admin endpoints, other users' accounts, or internal infrastructure without authorization.
• Illegal Content: Generating, transmitting, or soliciting content that violates applicable local, national, or international laws, including but not limited to content involving the exploitation of minors (CSAM).
• Reverse Engineering: Decompiling, reverse engineering, or attempting to extract the source code, algorithms, or internal architecture of the Service beyond what is publicly available.
• Resale & Redistribution: Using the Service as a backend for your own commercial API product, reselling access, or redistributing the proxy endpoint.

Violation of this Acceptable Use Policy may result in immediate account suspension, API key revocation, permanent ban, and/or referral to law enforcement authorities where applicable.

6. API KEY & AUTHENTICATION

Upon registration and acceptance of these Terms, you may generate a personal API key through your dashboard. Your API key:

• Is unique to your account and must not be shared, published, or embedded in publicly accessible code.
• May be regenerated at any time through your dashboard, which will immediately invalidate the previous key.
• May be revoked by the Operator at any time, with or without notice, for any reason including suspected abuse or Terms violations.
• Carries a prefix of fsk- for identification purposes.

We are not responsible for any unauthorized use of your API key resulting from your failure to maintain its confidentiality.

7. SERVICE AVAILABILITY & NO WARRANTY

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, statutory, or otherwise. Without limiting the foregoing, we specifically disclaim all warranties of:

• Merchantability: Fitness for a particular purpose or non-infringement.
• Continuous Availability: We do not guarantee uninterrupted, timely, secure, or error-free operation of the Service.
• Data Permanence: We do not guarantee the persistence, backup, or recoverability of any data stored in the system, including but not limited to user accounts, API keys, or request logs.
• Upstream Response Quality: We do not guarantee the accuracy, completeness, reliability, or appropriateness of responses generated by the upstream DeepSeek model.
• Response Times: Latency is subject to upstream DeepSeek API performance, network conditions, and server load.

The Service may experience downtime for maintenance, upstream outages, or unforeseen technical issues. We will make reasonable efforts to restore service but assume no obligation to do so within any specific timeframe.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Operator and its affiliates, agents, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, profits, or business opportunities.
• Service interruptions, downtime, or degraded performance.
• Unauthorized access to or alteration of your transmissions or data.
• Any content generated by the upstream AI model, including offensive, inaccurate, or harmful output.
• Any third-party actions, products, or services accessed through or in connection with the Service.

In no event shall our total cumulative liability to you exceed zero (0) USD, as the Service is provided entirely free of charge with no financial consideration received.

9. ACCOUNT SUSPENSION & TERMINATION

We reserve the right to suspend, restrict, or permanently terminate your account and API key access at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or the Acceptable Use Policy.
• Suspected abuse, spam, or automated exploitation of the Service.
• Excessive resource consumption that degrades service quality for other users.
• Legal or regulatory requirements mandating account action.
• Discontinuation of the Service (see Section 12).

Upon termination, your right to access the Service ceases immediately. We are not obligated to provide notice, justification, or an appeals process for account actions, though we may do so at our discretion.

10. INTELLECTUAL PROPERTY

The Freeseek name, logo, visual design, user interface, and all associated branding materials are the property of the Operator. You may not use, reproduce, or distribute any Freeseek branding without prior written consent.

Content generated by AI models through the Service is subject to the terms and licenses of the upstream DeepSeek API. We make no claim of ownership over AI-generated content and provide no license or rights to such content beyond what the upstream provider grants.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Operator, its affiliates, and contributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Content you submit, transmit, or generate through the Service.
• Any dispute between you and a third party relating to the Service.

12. MODIFICATION & DISCONTINUATION

We reserve the right to, at any time and without prior notice:

• Modify, update, or amend these Terms of Service.
• Change, restrict, or expand the features and capabilities of the Service.
• Adjust model access, rate limits, token quotas, or authentication requirements.
• Temporarily or permanently discontinue the Service in whole or in part.

Continued use of the Service after any such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, disputes shall be submitted to binding arbitration under the rules of the applicable arbitration authority in the jurisdiction of the Operator.

14. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. ENTIRE AGREEMENT

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
